On purchasing a licence to use one of our images you agree to the following:
The applicable law governing the agreement between us is Australian law.
Vibrant Imaging owns and retains copyright of the licensed images.
You will not deal with or use the licensed images in any way except in accordance with the type of licence agreement that you have chosen and paid for.
You indemnify us and keep us harmless from all liability, costs and/or damages in the event that you breach any terms of this Licence Agreement.
Upon payment of the licence fee, we will:
grant you a licence to use the image in accordance with the type of licence you have chosen; either a Royalty Free Licence or a Rights Managed Licence, and provide to you a file download link via your nominated email address.
You are not permitted to use the licenced image in a way that is unlawful according to the laws of Australia or any country in which the image is published in or downloadable or viewable by electronic means or otherwise, including but not restricted to, a use that is pornographic or defamatory.
Upon downloading the licenced image, you agree to:
retain as part of the image and electronic storage of the image, the meta-data that is embedded in the image including, but not limited to: any copyright symbol; the name Vibrant Imaging; and the image’s content identification number,
prevent any unauthorized third party from accessing and/or using the licenced image, and
protect and secure the licenced image (including using appropriate electronic security means) from unauthorized use by any third parties.
Royalty Free Licence:
The terms of use of our Royalty Free Licence are:
A royalty-free license allows you to use an image multiple times for multiple projects without incurring additional fees. Our Royalty-free pricing is based on image size and total number of times the image is used. However, the rights granted are non-transferable and so can only be used by you. This means that if you license a royalty-free product to be used in a derivative work by your client or any other person, they may not use the licensed product separately from the derivative work. Royalty-free licences are non-exclusive.
You may use the image for:
Web site - 1 of
Multimedia presentations - 1 of
Film or video production - 1 of?Magazines, books, book covers, textbooks or eBooks - up to 1000 each
Newspapers, editorials, pamphlets, catalogs, posters, email campaigns, e-news letters or brochures - up to 3000 each
CD/DVD cover art and advertising - up to 1000 each
In connection with your business identity on letterhead, or business cards - unlimited.
For usage that is greater than what is outlined above, please contact us to discuss the additional fees.
